Terms of Service

1. Who we are

Wyrdee ("we," "us," "our") is operated by David Wells trading as Wyrdee, a sole trader established in the United Kingdom. These Terms of Service ("Terms") govern your access to and use of the wyrdee website and services (the "Service").

2. Acceptance

By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Notice and our Refund Policy. If you do not agree, do not use the Service. You confirm you are at least 18 years old or have authority to bind the organization you represent.

3. The Service

Wyrdee is a generative AI tool that transforms ordinary text into corporate, "thought-leader" style language across multiple languages and intensity levels. The Service is provided for entertainment, communication and personal-branding purposes.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

5. Acceptable use

You must not use the Service to:

  • break the law or infringe anyone's rights;
  • commit fraud, send spam, or impersonate any person;
  • generate hate speech, harassment, sexual content involving minors, deepfakes intended to deceive, malware, or content promoting violence;
  • attempt to jailbreak, reverse-engineer, scrape, probe or interfere with the Service or its underlying models;
  • resell or redistribute the Service without our consent.

You are solely responsible for the prompts you submit, for how you use the outputs, and for confirming that you have the rights to any content you input.

6. AI outputs and accuracy

Outputs are generated by third-party AI models and may be inaccurate, biased, offensive, or otherwise unsuitable. The Service is not a substitute for legal, financial, medical, investment or other professional advice. You are responsible for reviewing outputs before relying on or publishing them. We reserve the right to filter, refuse, or moderate content.

7. Intellectual property

We retain all rights in the Service, including the software, branding, prompts, and underlying systems. Subject to these Terms and your subscription, you receive a limited, non-exclusive, non-transferable right to use the Service. As between you and us, you retain ownership of your inputs and the outputs generated for you, subject to the rights of underlying model providers and applicable law.

8. Subscriptions, payment and billing

Paid plans are billed in advance on a recurring basis (monthly) until cancelled. Your subscription will auto-renew at the then-current price unless you cancel before the renewal date. All payment, billing, tax and invoicing matters are handled by Stripe, and are also subject to Stripe's Buyer Terms.

9. Merchant of Record

Our order process is conducted by our online reseller Stripe. Stripe is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns.

10. Refunds and cancellation

Cancellation and refund handling are described in our Refund Policy. You may cancel at any time via your account settings.

11. Suspension and termination

We may suspend or terminate your access at any time for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated misuse. You may stop using the Service at any time by cancelling your subscription and closing your account.

12. Service availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

13. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or incidental damages, including loss of profit, data or goodwill. Nothing in these Terms limits liability that cannot lawfully be limited (such as for fraud or death or personal injury caused by negligence).

14. Indemnity

You agree to indemnify us against any claim arising from your misuse of the Service, your inputs or outputs, or your breach of these Terms.

15. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may have the right to bring proceedings in their country of residence.
